Our client was driving, when they stopped at a red traffic light.
As the lights turned green and they began to move off, a vehicle insured by the defender collided with the rear of their car without warning. The impact caused noticeable damage to the client’s vehicle.
Following the collision, the client attended a minor injuries unit and consulted their GP, where over-the-counter pain relief was recommended.
We instructed an Orthopaedic Surgeon to assess the client’s injuries and provide a medical report. The expert concluded that the accident caused whiplash associated headaches, moderate travel anxiety, and pain affecting the neck and right shoulder.
All symptoms resolved within nine months, with no long-term effects expected.
The injuries temporarily restricted the client’s everyday activities, particularly tasks requiring use of the right hand, and shoulder. They experienced interrupted sleep, difficulty completing domestic chores, challenges with meal preparation and shopping, and discomfort during extended periods of driving.
Despite early notification of the claim, the defender’s insurers failed to provide a substantive response or confirm their position on liability. To progress matters, and protect the client’s interests, we raised a court action.
Settlement
The client received a settlement of £3,700 covering pain, suffering and the inconvenience experiences as a result of the accident.
The successful resolution provided the client with closure and allowed them to move forward more confidently.
