Our client was travelling along the road when another driver pulled out from a junction and hit the rear passenger side wheel of his car.
As a result of the collision, our client suffered from a soft tissue injury to his neck, back and shoulder and his car was written off.
How we helped our client
We initially took on the case and obtained an independent GP report on our client's injuries. We then intimated the claim on the third party insurers.
Liabilty was denied by the third party insurers. They denied our client's version of events and claimed that he was to blame for the accident.
We immediately began ingathering information in support of our client's position including statements, engineering evidence and locus photographs. Our client was suffering outwith the prognosis period advised by the Independent GP, therefore we had him examined by a Consultant Orthopaedic Surgeon for the purposes of preparing a report.
We raised court proceedings for personal injury, vehicle damage and storage, our client's policy excess and inconvenience that he suffered. We obtained an expert engineer's report which supported our client's version of events. The Defender's solicitors obtained an expert engineer report which supported their version of events.
Settlement
At trial, after considering all the evidence we had put forward, the Sheriff found in favour or our client's version of events, and the client received £2,850 in settlement of his injuries.
