The majority of births are relatively straightforward. However, there are occasions where they become more complex and dangerous if oxygen flow is restricted.  

Adequate oxygen intake is vital to allow a baby to breathe and develop in the womb and if the oxygen flow stops, the baby's organs may be damaged. The brain is the part of the body most at risk, especially if oxygen levels are low for a prolonged period of time. 

If a baby’s brain is deprived of oxygen during labour or birth for a significant period of time, it can lead to brain injury, one of the most common is Hypoxic-Ischemic Encephalopathy (HIE). 

Symptoms associated with a baby suffering from HIE include: 

  • hyper-alertness 
  • irritableness 
  • eye rolling 
  • abnormal movements such as seizures 
  • reduced awareness 

Cerebral Palsy is an umbrella term for a range of neurological disorders that develop either in the womb, or before and shortly after a baby is born. 

Some causes are linked to birth trauma and often manifest from HIE. Babies are able to compensate for some depleted oxygen during birth, but not for extended periods of time. This means babies born prematurely who aren’t able to breath independently could suffer from brain damage if they aren’t ventilated swiftly. This could lead to the baby having lifelong physical and mental disabilities.  

Expert opinion indicates that between 8 to 12% of children diagnosed with cerebral palsy do so as a result of oxygen starvation, also known as birth asphyxia.  

Whilst there are a number of causes of HIE and Cerebral Palsy, there may be occasions where a baby is starved of oxygen as a result of negligent medical actions from hospital staff. Where this is the case, you may be able to make a claim for compensation. Where your child suffers from cerebral palsy, you may have to make significant adaptations to your life and even your home. You may need to give up work to care for them.
