Injured passenger awarded £2,670 after bus collides with low bridge

Our client was injured while travelling as a passenger on the upper deck of a public bus.

The bus driver attempted to drive under a low bridge despite clear height restriction signage, causing the vehicle to become wedged under the structure and resulting in significant damage to the upper deck. Emergency services attended the scene.

Our client initially attended A&E before seeking further treatment from a private GP, resulting in private medical expenses which were later recovered as part of the settlement. We obtained copies of their medical records and instructed a medical report from a General Practitioner to comment on our client’s injuries and prognosis. 

Our client sustained soft tissue injuries to the neck and upper back, with symptoms continuing for several months. They also suffered a facial laceration and abrasions caused by shattered glass, which healed within two weeks, however left a small residual scar measuring approximately 9 mm.

Due to a language barrier. a translator/interpreter was present at all stages of the claim, including medical appointments and discussions surrounding settlement. This ensured our client fully understood the process and the implications of each decision.

Settlement

As the insurers for the bus company failed to respond to our correspondence, a court action was raised to progress matters on behalf of our client. The case proceeded through the court process, with settlement being reached one week before the final hearing.

Our client received a settlement of £2,670 and was relieved the insurers settled his claim.
