We can provide a No Win No Fee option for most types of personal injury claim in Scotland, meaning that there is no financial risk to you. We can provide this for accidents at work claims, road traffic accident claims, industrial disease claims and most other types of accident claims.
What is no win no fee?
No Win No Fee is exactly as it sounds. If your case is accepted on a No Win No Fee basis, then we have deemed that your case has reasonable prospects of success. If, for any reason your case turns out to be unsuccessful, you will not be charged anything for our work. If there is any charge payable for an outlay this will have been agreed in advance with you.
So, if I win my case, I won’t need to pay any solicitors fee?
If your claim is successful, a proportion of our fees, and outlays and any other costs such as court fees etc will be covered by the other party. The solicitor you have instructed may have agreed with you an additional fee, which would only be payable when you settle your claim and will be deducted from any compensation you receive. This would have been agreed at the outset of the claim.
As well as the additional fee, depending on the circumstances of your claim, your solicitor may have recommended an After the Event Insurance policy be taken out. This protects you from any award of expenses in the event that your claim is unsuccessful. You will only pay the premium if your claim is successful, and this would be deducted from any award of damages you receive. We will advise you of the cost of the premium before taking out cover for you.

What happens if my claim is unsuccessful, who pays my solicitors fees?
If your case is not successful, you will not be liable for any fees or costs at all unless they have been agreed with you in advance. That also includes any insurance premium referred to above.
