Client secures £75,000 settlement following complex medical negligence claim

Our client approached us with a difficult and emotionally challenging medical negligence concern. Three years prior to her diagnosis, our client had undergone an MRI scan after which a pituitary tumour was not identified by the treating radiologist. This left our client with ongoing consequences that affected their day to day life and well being.

At the outset, it was clear that this was not a straightforward case. The medical issues were complex. The delay in diagnosing the tumour meant that it was allowed to grow which had several consequences. Our client’s sy,ptoms were worse as a result, the risk of recurrence was higher, and, in the event the tumour did recur, the risk to our client of a worse outcome was increased due to the delay. Whilst responsibility for missing the tumour was admitted, it was necessary to carefully analyse these consequences and understand which were connected to the delay and which would have occurred in any event. 

How we helped our client

We raised a Court action against the Health Board with the benefit of having obtained reports from several experts, including neurosurgical, neuropsychological, ophthalmic, orthopaedic, psychiatric and oncological. Their reports informed us on the impact upon our client resulting from the delay.

Settlement

An initial offer of £54,000 was made to resolve the case.

After carefully advising our client on the strengths of the evidence and the risks of under‑settling, we entered negotiations to push for a fairer outcome. Following negotiations, the case settled for £75,000, a significant improvement on the original offer. This outcome brought the matter to a close without the need for court proceedings and provided our client with financial compensation that properly recognised their experience.
