Circumstances of the accident
This rear-end collision compensation claim arose after our client was involved in a road traffic accident on the M8 motorway. Travelling in slow-moving traffic approaching a junction, our client brought their vehicle to a safe and controlled stop when the traffic ahead came to a halt. However, the driver behind failed to maintain a safe stopping distance and collided with the rear of our client’s vehicle without warning.
Despite this, the driver travelling behind failed to maintain a safe stopping distance and collided with the rear of our client’s vehicle without warning.
As a result of the rear-end collision, our client suffered injuries and incurred a number of financial losses.
How we helped
We pursued a personal injury claim on our client’s behalf. Liability was disputed throughout the case, with the defender maintaining that their insured driver had acted appropriately.
To support our client’s claim, we gathered and presented evidence demonstrating that the collision occurred because the defender’s insured failed to maintain proper control of their vehicle and a safe distance from the traffic ahead.
Court proceedings were raised to protect our client’s position and progress the claim. We continued to advance the case with strong supporting evidence and maintained a robust negotiating position throughout.
The collision caused our client to sustain soft tissue injuries to their neck, chest, back and left knee, together with an initial shock reaction. Medical evidence confirmed that a full recovery was expected within approximately six months.
In addition to their injuries, our client experienced financial losses arising from the accident, including vehicle damage, the replacement of a damaged child car seat, payment of their insurance excess and other out-of-pocket expenses.
Outcome
We successfully secured compensation of £14,500 for our client, despite liability being disputed throughout the claim.
The settlement compensated our client for both their injuries and financial losses and represented a positive outcome in a case where liability and the value of the claim were actively disputed.
