Worker injured from using faulty tools at work

Our personal injury team recently helped a client win compensation against their employer after he suffered a frozen shoulder from using faulty machinery

Our client was employed as a road worker with a local Council and as part of his duties he had to use pull start jackhammers. The tools he was using were faulty and he ended up developing a frozen shoulder. He attended an appointment with occupational health who recommended that his duties were rotated to prevent further injury, however this was not done. 

How we helped our client­

We intimated our client’s claim upon the Council responsible contending they were in breach of the Provision and Use of Work Equipment Regulations 1998, the Management of Health and Safety at Work Regulations, as well as common law duties.

The claim handlers for the Council denied liability by arguing that the tools were not faulty and that they had rotated our client’s duties.

Following the denial of liability, we collated further information along with expert medical evidence and we then raised court proceedings.

Before the case proceeded to trial, an offer of settlement was made to our client. We negotiated a higher offer and this was accepted by our client.
