Damages awarded for back injury after accident at work

We acted on behalf of our client in an action for personal injury which arose from an accident at work.

Our client, during the course of his employment, was painting warehouse containers. He was instructed to apply two coats of paint to the containers. Our client applied the first coat of paint and left the paint to dry. However, another employee of the Defender closed the doors of the container while the paint was still wet. The paint subsequently dried and caused the doors of the containers to stick to the frames. Our client returned a few days later to apply the second coat of paint to the containers. When he attempted to open the door of a container it was obvious that the door was sealed shut by paint. As our client pulled the door handle, he felt a crack in his lower back.

We thereafter raised court proceedings against the client’s employer, whom we held responsible for the accident taking place.

How we helped our client

As a result of the accident our client sustained a soft tissue injury to his lower back which lasted for a year from the date of his accident.

Due to his injuries our client was unable to work for two weeks following the accident and required assistance with everyday tasks at home.

As well as being able to claim compensation for our client’s injuries we were also able to include a loss of earnings claim and a claim for assistance.

Settlement

We were able to obtain a settlement of £4,250 for our client in respect of all heads of claim.
