At the time of the incident, John was working as a driller on construction sites. In his role, he had to use a range of drilling equipment. Use of this equipment exposed him to vibration at work. As a result, he unfortunately developed Hand Arm Vibration Syndrome (HAVS) which affected both of his hands.
How we helped our client
We notified a claim to his employer And liability was denied. We relied on a claim under the Control of Vibration at Work Regulations 2005. In terms of the regulations, John’s employer was required to keep a daily record of the amount of vibration at work he was exposed to. For several years of John’s employment there were no records at all and it then became clear that later records were falsified by his employer. We instructed an opinion from an expert vibration engineer. We raised court proceedings and then instructed medical reports. Despite maintaining a denial of liability his employers’ insurers then agreed to settle the claim.
Settlement
Compensation was agreed at £30,000.
