Damages awarded after our client sustained a burn injury at work

We acted on behalf of our client in a claim for personal injury arising from an accident at work.  

Our client was employed as a chef. During the course of his employment, he was using a thermal mixer.  A thermal mixer is used to heat up sauces and it can also be used to blitz the contents into a smooth sauce. The thermal mixer has a small attachment at the top which is removed completely to insert seasoning. The attachment has a hole in the side which allows air to escape.

On the day of our client’s accident, this attachment was missing. Our client was instructed to use a metal cup instead and as he removed the cup, there was a sudden change in pressure. Suddenly and without warning, the sauce spurted from the mixer onto our client’s arm which caused burn injuries.

We raised court proceedings against our client’s employer, whom we held responsible for the accident taking place.

How we helped our client

As a result of the accident our client sustained a partial thickness burn and suffered a loss of earnings due to the time he had to take off work following his accident.   

Settlement

We were initially offered £1,870.00 by the defenders in this case, however, upon overcoming their argument of contributory negligence we were able to obtain a settlement of £2,250.00 for our client in respect of all heads of claim.
