Our client was driving to his holiday home in Loch Lomond when his vehicle was hit by a coach travelling in the opposite direction.
Fortunately, our client suffered no physical injuries, but he was left with psychological symptoms. He was reluctant to drive and often asked friends, family and colleagues to drive instead. Our client eventually sought help from his GP and instructed us to pursue a claim against the coach company.
How we helped our client
We instructed a medical expert to examine our client and to prepare a report on our client’s symptoms. The expert considered our client was suffering from a specific phobia.
The coach was registered outside of the UK and so we instructed the assistance of the Motor Insurers Bureau to identify the correct insurer. We then intimated our client’s claim on the coach’s insurers.
The insurers failed to recognise the validity of our client’s claim as he had not suffered any physical injury. They refused to make any settlement offers.
We raised a court action on behalf of our client. We were confident to proceed to court as we had supportive medical evidence. However, we secured a reasonable settlement for our client shortly prior to trial.
