The Pursuer was a passenger in a vehicle travelling in Currie, Edinburgh, when an accident occurred. The driver of the vehicle attempted to pull out from behind a parked car but instead drove straight ahead into the driveway of a nearby property, colliding with the front wall. The Pursuer was a non-fault passenger in the incident.

As a result of the accident, the Pursuer suffered soft tissue injuries to his neck and developed a moderate depressive disorder, as well as an associated fear of being in vehicles and an acute stress reaction.
The Pursuer required medical attention from his GP and was recommended for cognitive behavioural therapy (CBT) to address the psychological impact of the accident. His physical symptoms resolved within approximately six months, but his psychiatric injury remains ongoing. Following the accident, the Pursuer received necessary care and services from a family member for approximately four weeks.
To support the claim, we obtained medical evidence from a GP and a psychiatrist, confirming the nature and extent of his injuries and the need for ongoing treatment. Due to the third-party insurer questioning the veracity of the Pursuer’s injuries, a Court action was raised to progress matters.
Settlement
The claim was presented under several heads: solatium (compensation for pain and suffering), services (care and assistance), and miscellaneous expenses. The sum sued for reflected the seriousness of the Pursuer’s injuries, the impact on his daily life, and the costs of recommended treatments. With robust medical evidence and a clear account of the care provided, the Pursuer was able to secure a settlement that recognised both his physical and psychological injuries, his need for care, and the disruption to his life.
