£12,900 settlement after offending insurers failed to defend

Our client was stationary whilst indicating to turn right into a side road. A third-party car travelling behind our client failed to notice our client’s stationary vehicle. The third-party driver collided with the rear of our client’s car.   

We instructed a medical report from a Trauma and Orthopaedic Surgeon to comment on our clients’ injuries and prognosis. Physiotherapy was recommended to aid our client’s recovery. Treatment was promptly arranged.

A claim was intimated to the Insurers for the Third-Party driver. No response was received, and a court action was subsequently raised. 

Issues with the claim

The third-party Insurers failed to respond to the Court Action in the allocated timeframe. We therefore applied to the court for Decree in absence. The Decree was granted and served upon the Third-Party Insurers.

Settlement

Our client was diagnosed as suffering from soft tissue injuries to their head, neck mid and upper back, right arm and wrist, right foot and ankle. Our client also suffered from associated travel anxiety and bruising.

Our client’s car was damaged, and they required the use of a hire vehicle while their own car was being repaired.

Fortunately, the Decree prompted a response from the Third-Party Insurers and settlement was agreed at £12,900.
