Our client was employed in a role that involved repairing large machinery at engineer pits. After completing a repair on a machine designed to manoeuvre heavy steel plates over the pits, he was required to take photographs of his work.
To do so, he walked across one of the steel plates, unaware that it had not been properly secured. There were no signs or warnings indicating the hazard. As a result, the plate flipped beneath him, causing him to fall onto it before tumbling into the pit below.
Our client sustained multiple injuries, including broken ribs, bruising and swelling to his legs, and back pain.
We pursued a claim against his employer, arguing that they had failed in their duty to provide a safe working environment and had exposed him to an avoidable risk of injury.
Settlement
The Defender initially offered a settlement of £1,500. However, after obtaining medical evidence from an orthopaedic expert and engaging in negotiations, we successfully secured £3,500 in compensation for our client—ensuring fair recognition of his injuries and suffering.
