Kevin was on a night out at a local nightclub and as part of the floor show, the operators of the club had arranged for a large number of foil wrapped condoms (FWC) to be thrown onto the dance floor. Whilst dancing, Kevin slipped on the FWC and suffered from a broken leg as a result.
How we helped our client
We notified Kevin's claim to the operators of the nightclub. We corresponded with loss adjusters appointed by their insurers who refused to accept liability. We therefore required to raise court proceedings.
We thereafter instructed an orthopaedic expert to prepare a medical report commenting upon Kevin's injuries. Prior to the case being heard in court, the insurers accepted liability, and put forward an offer of settlement.
The claim settled in the sum of £12,000.
Testimonial
Kevin said: "While I appreciate there was a comical element to the claim, the loss adjusters just wouldn't deal with it seriously. I was happy with the way Lindsays raised proceedings when the loss adjusters wouldn't accept liability. I was happy with the way they pushed my claim forward and I was happy with the compensation that was agreed."
