The circumstances of the accident are that our client was working as a Plant Operator and was acting as a Second-Hand Man to a Driller. Our client had finished drilling a hole and was working on removing the casing of the drill when suddenly and without warning the shank and the casing of the drill fell striking him on his left hand.

We intimated our client’s claim to his employers, advising that the equipment was defective and not maintained properly and therefore exposed persons such as our client to risk of injury. Had our client’s employers carried out the appropriate health and safety inspections, it would have been identified that the equipment was hazardous and that an injury was reasonably foreseeable.

Our client suffered injury to his left hand as a result of this incident and required to attend hospital for treatment.

We ingathered witness statements and a liability report from an expert. We then raised Court proceedings and ingathered medical evidence in relation to our client’s injuries. Prior to the case proceeding to Court it settled in the sum of £25,000.
