Circumstances of claim
Charles was on holiday in France. He was knocked down by a motorcyclist and suffered a number of injuries, including a head injury, fractured cheekbone, broken ribs and hearing loss. This was a deliberate hit and run.
How we helped Charles
We obtained a Police Report from France which indicated the motorcyclist was untraced. We notified a claim to the Motor Insurers’ Bureau (MIB) who were the UK representative of their equivalent in France, the French Guarantee Fund (FGF). The MIB and FGF are responsible for settling claims against untraced motorists. We obtained Reports from an Orthopaedic Consultant, Consultant Psychiatrist, ENT Consultant, Vocational Consultant and Occupational Health Consultant. The claim had to be valued according to French law. We instructed a French legal expert and French medico-legal expert to help value the claim. We instructed counsel on our client’s behalf. We raised Court proceedings on behalf of Charles to protect his right to claim and then negotiated a settlement of 80,000 Euros. Charles was happy with the settlement obtained.
