Circumstances of accident
We acted on behalf of our client in an action for personal injury which arose from an accident at work.
Our client was operating machinery during his employment at local fishing docks. He had previously asked the occupiers of the site to clear away fishmeal spread all over the floor of the dock during a previous unloading operation, which, when mixed with moisture created a greasy paste that covered his working area. Upon exiting the cab of his crane on the morning of the incident, our client slipped on the fishmeal and fractured his ankle. As a result of his injuries, our client was absent from work and suffered a loss of earnings. He also required assistance from a relative with day to day living activities.
How we helped our client
The company which ran the docks believed our client had materially contributed to his own accident, stating that he should have checked the floor was clear of fishmeal before exiting his cab. We raised court proceedings against the occupiers of the dock, the organisation which had left the fishmeal on the dock and also our client’s employers for failing to ensure that his place of work was safe. The case proceeded under the Workplace (Health, Safety and Welfare) Regulations 1992 and the Management of Health and Safety at Work Regulations 1999.
Settlement
We achieved a settlement for our client in the sum of £12,000.
