Our client was injured during his employment as a retail delivery driver. Whilst delivering cages of food to one of the stores, the tail lift on his lorry failed resulting in the client falling approximately 10 feet to the ground below. The cage he was working with also fell off the tail lift on top of our client.

As a result of the fall our client was knocked unconscious and was taken to hospital for observations. Our client sustained only minor soft tissue injuries and serious lacerations to his scalp. He was unable to work for a period of time due to his injuries and suffered a loss of earnings as a result.

How we helped our client

We intimated our client’s claim to their employer’s citing their breach of the Management of Health & Safety at work Regulations and Provision and Use of Work Equipment Regulations. The Employer’s representatives responded to us to confirm that liability was accepted for our client’s accident and confirmed that the lorry our client was working on had been removed from use due to the fault with the tail lift.

We ingathered our client’s medical records and sought a report from an orthopaedic consultant on our client’s soft tissue injuries. The orthopaedic consultant also recommended a report was obtained from a plastic surgeon in respect of our client’s lacerations to his scalp. Both reports were provided to the Employer’s representatives for settlement purposes.

Settlement

Our client received a total settlement award of £12,000 which he was delighted with. The settlement sum included his lost earnings which were sustained as a direct result of the accident.
