Circumstances of accident
Our client worked as a retail assistant with a large chain of discount stores. As part of her usual duties, she was required to remove stock from the shelves. On the day of the accident, our client was removing heavy stock which she had loaded onto a wheeled stool for carriage through the store, as was standard practice within that store. While pushing the stool, it suddenly came to a stop and our client fell over the stool to her injury.
As a result of the accident, our client fractured her wrist and suffered a chipped tooth and laceration to her upper lip. She required to undergo surgery on her wrist. She now suffers ongoing discomfort and permanent weakness in her wrist.
Our client requires assistance with household tasks and is unable to continue to perform her duties as a retail assistant.
How we helped our client
We intimated a claim on her employer’s insurers. Liability was not accepted by the insurers and so we raised a court action on our client’s behalf. We recovered our client’s medical records and instructed expert witness reports.
Settlement
Although the insurer did not accept liability, we managed to negotiate settlement and successfully obtained £20,000 for our client.
