At the time of the incident, Jean was working in a care home. Most of the residents in the care home have dementia and problems with incontinence. There is a mat beside their beds which has a pressure alarm. Jean was trained to respond immediately when the alarm went off as when the residents are out of bed in the care home they are at danger from injuring themselves, including from falling. Jean responded immediately when the alarm went off. Unknown to her, the resident had inadvertently urinated on the floor and she slipped on the spillage breaking her wrist.
How we helped Jean
We notified a claim in respect of this slip at work to her employer. Liability was denied. We arranged to have the floor tested for slip resistance. The test proved the floor was dangerously slippery when wet. We instructed an engineer’s report about what her employer should have done to protect against the risk of Jean slipping. We showed that her employer should have either:-
- Fitted slip resistant flooring; and/or
- Provided Jean with slip resistant shoes.
We instructed reports from an orthopaedic consultant to quantify the claim and then raised a court action. The action settled close to trial when settlement was agreed at £20,000.
