Circumstances of accident
We acted on behalf of a client who sustained a concussion and post-concussion syndrome as a result of a light falling on her head at her place of work.
We intimated a claim upon our client’s employer based on their failures to provide a safe workplace to the employees and to maintain the workplace to a suitable standard. We argued that they were in breach of their obligations in terms of several Health & Safety Regulations. Broadly, our position was that our client’s employer had failed to keep the workplace in efficient working order and in good repair.
Liability was admitted. However, the employer failed to make a suitable offer which would properly compensate our client for her injuries, particularly given that some of her post-concussive symptoms were continuing. We therefore raised a Court action to ensure that our client was properly and fairly compensated.
How we helped our client
We obtained an expert medical report from a Consultant Neurologist which set out the extent to which our client’s concussion and post-concussion symptoms impacted her. This also provided an opinion on prognosis i.e. the time period of symptoms which could be attributed to the head injury.
Settlement
The first offer received before raising a Court action was £6,000. We were able to obtain a settlement of almost double this amount in the sum of £10,000 for all heads of claim. This resulted from a robust approach to negotiation which included raising a Court action.
