Circumstances of accident
Our client was working in the course of his duties as a delivery driver with a cage of produce to the delivery point of a coffee shop vendor. Our client required to negotiate the cage through a door, past obstacles in a passageway and turn and lift the cage over a ridge in tight conditions, he also required to proceed to pass to move bins to reach the back door.
The cage became jammed as our client attempted to tilt the cage to get over the ridge and ultimately landed on top of our client's foot. The cage then toppled landing on our client's leg. Our client suffered a minimally displaced bimalleolar fracture to his ankle. He was admitted to hospital as a result. He was unable to work for four months following the incident albeit that his pain and discomfort were not fully resolved.
How we helped our client
We intimated the claim directly upon the employer. The claim was thereafter passed to the insurer to deal with. Following the investigation and correspondence between us and the insurers, liability was admitted in full.
Legal Action and Settlement
We thereafter sought to obtain medical evidence in the form of a report from a Consultant Orthopaedic Surgeon. Our client also suffered loss of earnings as a result of his absence from work following the accident which we successfully recovered for our client.
Once the medical report had been received and approved by our client, we forwarded this onto the third-party insurer and negotiated settlement of his claim in the sum of £11,500.
