Our client was bullied and harassed by his colleagues at work, including members of his management team. Having been subjected to this treatment since 2007, our client developed anxiety and depression and was retired on the grounds of ill health.
How we helped our client
We intimated a claim to our client's employers who denied liability. They argued that our client was never bullied and that he was aggressive and intimidating to his colleagues.
We required to obtain medical evidence confirming the nature and extent of our client's injuries and then raise court proceedings in the Court of Session in Edinburgh. The court action was defended, and our client's employers cited 40 witnesses to give evidence against our client.
As the case progressed through court, our client was subjected to further threats and intimidation. We provided support to and protected the interests of a vulnerable client with significant mental health problems. We obtained expert evidence from psychiatrists and occupational psychologists to support his claim in respect of his injuries, wage loss and pension loss.
Settlement
The court action settled shortly before the start of a three-week Proof Diet in the Court of Session. We secured settlement of £70,000 in respect of our client's psychiatric injury and the financial losses resulting from his ill health retirement.
