Circumstances of claim
Sandra worked for the Co-op. She had to move some stock using a trolley. One of the wheels of the trolley was defective which resulted in the trolley coming to a sudden stop as Sandra was pulling it causing a twisting injury to her knee. There was evidence that her employer knew of the problem with the trolley.
How we helped Sandra
We intimated a claim to her employer. This on the basis that the trolley was defective work equipment for which they were responsible. In the event the defect with the trolley was one of manufacture her employer would still be liable in terms of the Employer’s Liability (Defective Equipment) Act 1969. Her employer accepted liability. Thereafter we instructed an orthopaedic opinion regarding Sandra’s knee injury. This suggested she had suffered a 6 months’ knee injury and we negotiated a settlement soon thereafter.
