Our client was employed as a chef in a hotel and she regularly required to go to a neighbouring hotel to borrow products for the kitchen. As our client was leaving the hotel, via the main entrance, she slipped on a wet floor. The area where the floor was wet did not have any warning signs in place. 

As a result of the accident, our client suffered an injury to her ankle and was absent from work for a period of two months following the accident. 

How we helped our client

We intimated our client's claim to her employers stating that they were in breach of their common law duties, and referred them to the Workplace, Health, Safety & Welfare Regulations 1992. This matter was then passed to her insurers who commenced their investigations into the matter. Thereafter, they wrote to us to confirm that liability was admitted for the incident. 

We proceeded to recover a copy of our client's medical records and instructed a report from a Consultant Orthopaedic Surgeon. We also required to have our client attend for an MRI scan to determine how the injury would affect her in the future, as she was suffering from ongoing pain in her ankle. We raised Court proceedings to protect our client's claim. We obtained a further specialist report which stated that a full recovery would be achievable if our client were to undergo surgical treatment. We included the cost of the reconstructive operation in our statement of valuation of claim which was lodged with the Court. 

The Defenders solicitors had our client examined by their own medical expert and a report was prepared. 

Settlement

Prior to the matter proceeding to a court hearing, the Defenders solicitors made an offer of settlement in the form of a Minute of Tender for the sum of £16,000 to which our client happily accepted.
