Following a diagnosis of mesothelioma, we were instructed to act on behalf of the Pursuer.
How we helped our client
The claim was intimated within a week of the initial instruction and we proceeded to carry out medical investigations and obtain a supportive medical report. Within two months of being instructed, we had raised proceedings in the Court of Session.
The Pursuer’s life expectancy was 12 months from the date of his diagnosis and we were able to settle his claim before his death. This is very rare for mesothelioma claims of this type. In the short time that we had, we investigated the companies involved and took detailed statements from the Pursuer and other witnesses in relation to exposure to asbestos. These investigations allowed us to determine where the exposure took place and to identify the correct defender. We obtained a supportive engineering report and traced the insurers who were on cover for the relevant period of employment.
Outcome
By lodging a Pursuer’s Offer, we were not only able to settle our client’s claim on favourable terms but to obtain additional penalty damages when the defenders eventually accepted the Pursuer’s Offer some 6 months after it was made. The case settled for £180,000.
