John was aged five when he had an accident resulting in a broken arm. Over the next two years he had several falls which resulted in the same arm being broken again.
Our Investigation
We instructed an opinion from a paediatric orthopaedic consultant. It became apparent that in his first accident John dislocated his elbow. This was not picked up on by his doctors at Ninewells Hospital in Dundee, until he was eight. As well as the orthopaedic report we instructed further opinions from a paediatric radiologist and child psychologist. Due to his injuries John’s employability was compromised and so we instructed a further opinion from an occupational health expert as well as an opinion from a vocational expert.
Court Action
The Health Authority would not accept full responsibility for John’s claim and so a Court action was raised. This was progressed until a settlement was agreed with the Central Legal Office of the Health Authority.
Legal Basis of Claim
The case arose out of medical negligence at Common Law as the view of the experts instructed by us was that no reasonable paediatric orthopaedic doctor or paediatric radiologist would have failed to pick up on the dislocated elbow.
Outcome
A settlement was agreed at £25,000.
