Damages of £25,000 awarded to our client after she slipped on a dancefloor and suffered a broken wrist

Our client was attending a 21st birthday party at a social club. Whilst our client was on the dance floor, she fell due to a spillage on the floor.

As a result of the incident, our client sustained a broken wrist in which she required to undergo surgery.

We intimated our client’s claim to the third party advising that we were holding them liable under the Occupiers Liability (Scotland) Act. The insurers for the third party acknowledged the claim and advised that they would carry out investigations.  Upon completion of their investigations, they confirmed that liability was denied for the incident.

We recovered a copy of our client’s medical records, applied for After the Event Insurance, and obtained witness statements. We obtained supportive expert evidence that the flooring was a slip hazard when wet. We further instructed an expert to prepare a report in relation to the injuries our client sustained.

Upon receipt of all this evidence, we proceeded to raise a Court action. Prior to the matter proceeding to a Court hearing, we received an offer to settle our client’s claim in the sum of £25,000.
