We were instructed by a number of family members of their late female relative who was tragically killed in a road traffic accident outside of Edinburgh in July 2017.
We received instructions from the husband of the woman who had died, as well as their two children, and the front seat passenger in the car.
The third party was an American national driving on the wrong side of the road in a hire car. The third party had emerged from a side road and drove up the wrong side of the road. The collision killed the family member as well as seriously injuring her husband, the driver and the front seat passenger.
How we helped our clients
We were instructed to negotiate settlement of the claim on behalf of the front seat passenger. This involved us obtaining a number of expert reports. The injuries to the driver and front seat passenger were extensive and care was required to clarify the longer-term prognosis on each case.
Further, we were instructed to act on behalf of the immediate family of the female relative who was killed. This comprised of her husband, her daughter and her son. We obtained statements from them and thereafter required to negotiate extensively with the third party insurers. We were eventually able to reach settlement on all claims.
Outcome
We settled all of the claims for a combined total of £285,000.
