Circumstances of claim
Liv was in hospital. She had dementia and was a known falls risk. She needed the bathroom. She was provided with a commode and was left unsupervised and unattended. As a result, she fell and broke her hip.
How we helped Liv
We intimated a claim to the hospital. Liability was denied.
We thereafter instructed an opinion from an independent nursing expert. We were able to show that the hospital had failed to devise and implement a suitable risk assessment to deal with the risk of leaving Liv unattended. The hospital could have eliminated the risk by using a hoist.
We raised a court action. We then instructed an orthopaedic report regarding Liv’s injury.
We were able to progress the court action to a settlement. The agreed settlement was £15,000.
