Circumstances of the claim
Morag had back problems and went to hospital. She had several scans including an MRI scan. Present on the scans was a mass which turned out to be an ovarian cyst. The Radiologist and Doctors treating Morag failed to spot or act upon the results of the scan and as a result the cyst became malignant leading to ovarian cancer.
How we helped Morag
We notified a claim to the health authority. We instructed reports from a radiology expert who confirmed it was negligent to miss and treat the ovarian cyst. Morag has had to go through surgery and chemotherapy which she would not have had to do had the cyst been treated earlier. This has had several side effects. To quantify the claim, we instructed reports from a Gynaecological Oncologist, Consultant Oncologist, Orthopaedic Consultant, Psychiatrist, Neurologist, Care Needs Expert and Dermatologist. We raised a court action on Morag’s behalf. For a long time, the Health Authority would not accept liability. Ultimately, they did so and made interim and final compensation payments of £155,000. If Morag does not survive the ovarian cancer, her relatives will also be entitled to claim compensation, which will add a further £350,000 to the claim’s value.
