Circumstances of accident

We acted on behalf of a grandmother in a medical negligence claim where doctors negligently failed to diagnose a condition affecting her granddaughter’s liver. The delay was approximately four years. This led to the requirement for liver transplant surgery which regrettably did not work due to rejection. Our client’s granddaughter was thereafter treated palliatively and sadly died.

Our client wished to pursue damages for loss of society from the Health Boards involved for their negligence in failing to timeously make a diagnosis. 

How we helped our client

The Health Boards denied liability for what happened. Even if they were found liable for the delay in diagnosis, their position was that the patient’s death was in fact caused by non-compliance with treatment.

In terms of liability and causation, expert reports were obtained from a doctor who concluded that had appropriate testing been undertaken, the liver condition would have been diagnosed at a much earlier stage. This would have resulted in the deceased being treated with medication and avoidance of the transplant and subsequent death.

Court proceedings were raised against the Health Boards at the Court of Session.

Settlement

Ultimately, we managed to negotiate settlement of our client’s claim in the sum of £35,000.
