Circumstances of the accident
Our client attended the hospital for surgery following a tear to his Achilles Tendon. Approximately 4 months following the surgery, he was reviewed by the Orthopaedic Team as a result of swelling and discomfort in his thigh. Unfortunately, Scans revealed that he had a segment of a retained drain within the wound. The retention of the drain led directly to the requirement of a further surgery.

We intimated the claim on the NHS, and they agreed to enter into settlement negotiations.

Our client suffered swelling and discomfort to his thigh. The retention of the drain led to increased discomfort between the primary surgery and the removal. The retention of the drain led directly to the requirement of a further surgery. His injuries largely resolved after 5 months.
We instructed a Breach of Duty Report to comment on the negligent treatment and thereafter a Medical Report to determine the extent of his injuries and prognosis for the future. Settlement was agreed at £8000.
