Circumstances of accident
We acted on behalf of the Pursuer in a medical negligence claim where doctors negligently failed to diagnose bone cancer. The delay was approximately two years. The Pursuer was a breast cancer survivor and despite her declining health no initial investigations were carried out. Eventually, tests were carried out which regrettably confirmed she was suffering from a terminal illness.
Our client wished to pursue damages from her GP for their negligence in failing to timeously make a diagnosis.
How we helped our client
In terms of liability and causation, expert reports were obtained from a doctor who concluded that had appropriate testing had been undertaken, the metastatic disease would have been identified at a much earlier stage. This would have resulted in the Pursuer being treated with medication. Sadly, the Pursuer was in uncontrolled pain for over 18 months.
The MDDUS agreed to enter into settlement negotiations.

Ultimately, we managed to negotiate settlement of our client’s claim for a five-figure sum.
