Cyclist awarded five figure sum from Waitrose after black ice fall

Our client suffered a serious accident in a Waitrose car park during the winter months. The incident occurred when his bicycle came into contact with black ice, causing him to slip and sustain multiple fractures. Determined to seek justice and compensation, he pursued a personal injury claim against Waitrose for their alleged negligence in maintaining a safe environment in their car park.

The incident not only led to extensive medical treatments but also resulted in a considerable impact on his daily life, including a prolonged period off work and ongoing rehabilitation.

How we helped our client

A roads expert was consulted to assess the maintenance practices in the Waitrose car park. This expert provided insights into whether reasonable steps had been taken to prevent the formation of black ice and ensure the safety of pedestrians and cyclists.

Waitrose initially denied liability although offered to settle the claim shortly after a Court action was raised in Edinburgh. He received a five-figure sum, and importantly the correct rehabilitation required as a result of injury.

Settlement

The case highlighted the importance of engaging the correct experts to build a robust case in a personal injury claim involving complex circumstances. The successful outcome demonstrated the effectiveness of a thorough legal strategy in holding businesses accountable for the safety of their premises.
