Our client was shopping in her local supermarket at around 6.30pm one evening. She approached a self-service checkout.
Suddenly, our client slipped on a spillage of milk on the floor. The spillage of milk had been on the floor since 4.30pm that day. The spillage had been reported. No steps had been taken to clean up the spillage or place warning signs around it.
As a result of the accident, our client fell heavily onto her right knee. She suffered from soft tissue injuries to her neck, right shoulder, lower back and coccyx and both of her knees. She also sustained a chipped tooth.
How we helped our client
We intimated our client's claim to the supermarket. Following a period of investigation, they responded to us to confirm that they accepted liability for our client's accident.
We proceeded to recover a copy of our client's medical records and instructed a report from a Consultant Orthopaedic Surgeon.
We also required to raise Court proceedings to protect our client's claim.
The medical report confirmed that our client's injuries as a result of the accident would have resolved within nine to twelve months from the accident.
Settlement
Prior to the matter proceeding to a Court hearing, the Defenders solicitors made an offer of settlement in the form of a Minute of Tender for the sum of £5,000.
