Circumstances of accident
We acted on behalf of our clients in a claim against a local inn which arose out of an occupier’s liability incident.
On the day of the incident our clients attended a local inn for lunch. Due to Covid restrictions at the time, the meals were served outside on picnic style tables. As the food was brought out by staff, the picnic table our clients were seated at collapsed on top of them, trapping them underneath. Following the accident, our clients were advised that a similar incident had happened due to the tables being unstable. Our clients both sustained soft tissue injuries to their backs and bruising as a result of the table landing on top of them.
How we helped our client
Prior to contacting us, our clients attempted to resolve this with the inn direct. However, the owners of the inn advised they were not liable for what had happened. Once instructed, we intimated the claims on to the owners of the inn and their insurers. The incident was fully investigated by the insurers and liability was eventually admitted. Our clients were assessed by an independent GP in respect of their accident related injuries.
Settlement
Matters were able to be resolved without the need for litigation and we were able to secure settlement in the respective sums of £2,000 and £1,800 which our clients were delighted with.
