Our client had visited his local Boots store and purchased ready-made bottles of Cow and Gate milk for his newborn son.
After our client had returned home, he proceeded to feed his son one of the bottles. Unfortunately, the milk was some three weeks out of date, and our client did not notice this until his son had consumed the bottle.
Our client's son was unwell with sickness and diarrhoea for a period of two to three days. The consumption of the out of date milk caused our client and his partner severe distress, worry and upset.
How we helped our client
We intimated a claim to Boots with an offer to settle. Boots passed the claim to their solicitors who investigated matters and ultimately agreed to pay our client compensation. Their initial offer was unreasonable due to the circumstances and injuries caused but we negotiated an increase in settlement on our client's behalf.
Settlement
After negotiations an offer of £850 was accepted.
