Our client was staying at a holiday park when she slipped on a wet floor in the reception area of the swimming pool.
As a result of the accident, our client suffered from soft tissue injuries to her right wrist, right knee and lumbar spine.
How we helped
We took the case on and intimated the claim on the third party. Liability was continually denied by the third party, who claimed that they had an adequate cleaning system in place and that there was no history of people slipping on the floor. Unfortunately, we were unable to arrange an inspection of the flooring in place at the time as this was changed in the period between the accident and our investigation of the claim. We were aware that the flooring was a sheet of vinyl material.
Our client and another witness stated that there were no wet floor signs in place and that prior to her accident two other people slipped and fell.
As part of our investigations, we obtained an expert report from a health & safety specialist to comment upon the suitability of the flooring that was in place at the time of the accident. Unsurprisingly, the sheet vinyl flooring was considered very likely to cause somebody to slip when wet. As it was the reception area of a swimming pool, we maintained our position that the holiday park would be liable on the basis that the type of flooring would require to be continually dried to avoid the risk of slipping.
We recommended raising court proceedings to acheive resolution of our client's claim.
Outcome
Shortly after serving the court action, we received an offer to settle the claim for the full amount of our valuation. Settlement was agreed in the sum of £13,460.
