Circumstances of accident
On the day of the accident, our client was driving along a road, when she suddenly required to perform an emergency break. The vehicle behind her failed to stop in time and collided with the rear of our client’s vehicle.
As our client’s right leg was fully extended with her foot pressing on the break at the time of the incident, the force of the impact jolted her forward resulting in our client suffering a lateral meniscal tear which required surgical treatment. Our client is expected to revert to her pre-accident state within two years following the accident.
How we helped our client
We intimated the claim to the third-party insurers. Liability was accepted and a pre-medical offer in the sum of £2,000 received, which was rejected. The claim was then put on hold while the Pursuer underwent surgery and subsequently, we recovered copies of both her GP and hospital records. In the interim while we were awaiting a date for our client to be examined by an expert orthopaedic surgeon, which was delayed due to the coronavirus outbreak, the third-party insurers made an increased pre-medical offer of £8,000. Following negotiations, we settled our client’s claim in the sum of £16,000.
