Our client was driving a motorcycle in France, when another vehicle pulled out of a side road, and collided with his motorcyle.
Our client suffered from a rotator cuff tear and a neurapraxia to the C9 nerve root in his cervical spine. The Pursuer required to undergo surgery to repair his rotator cuff tear. The Pursuer was unable to work for two months following the accident and he suffered a loss of earnings.
We reqiuired to recover copies of his medical records and had him examined by a medical expert for the purposes of a medical report. We were also able to successfully claim for loss of use of his vehicle.
Outcome
We required to raise court proceedigsn in the All Scotland Personal Injury Court against the French insurer. The French insurer admitted liability and we successfully settled the claim for £25,000.
