We were instructed by our client to obtain compensation following a very serious road traffic accident which left him with multiple injuries, including having to have his spleen removed which left him immunocompromised during the Covid-19 pandemic.
Our client was driving his car on the A75, Dumfries, when suddenly a car on the opposite side of the road attempted to overtake a vehicle travelling ahead of it on a blind corner. The third-party vehicle collided head on with our client’s vehicle.
Our client’s vehicle spun and slid down an embankment landing on its side. Our client had to be cut out of the vehicle and rushed to hospital where he remained for 15 days following the accident. Our client suffered numerous injuries including a traumatic brain injury, facial lacerations and scarring, multiple soft tissue injuries, transverse process fractures to his lumbar spine, a traumatic dissection of the coeliac axis, and a significant injury to his spleen which required him to undergo an emergency laparotomy and splenectomy. In addition, he suffered significant psychological injuries following the accident including Acute Stress Disorder and PTSD.
As a result of the splenectomy, our client is now immunocompromised and has to take penicillin and aspirin long term due to being at increased risk of overwhelming infection. As a consequence of being immunocompromised, our client had to shield for significant periods as a result of Covid-19 and suffered a loss of earnings as a result of this.
How we helped our client
We ingathered medical evidence in relation to our client’s injuries and raised court proceedings upon the third-party insurers. Throughout the proceedings, we obtained expert advice in relation to our client’s immunocompromised state and how this would affect him, throughout his life.
Settlement
The Defender’s insurers initially made an offer of £35,000 to settle the case. Prior to the case proceeding to Proof, we agreed settlement on behalf of our client in the sum of £90,000.
