Circumstances of accident
We acted on behalf of a cyclist in a claim for personal injury arising from a car driver failing to give way at a T-junction and proceeding into the path of our client’s bike. Our client was thrown from his bike onto the pavement and he sustained a number of injuries.
Given the circumstances of the accident, liability was not disputed. We raised a court action on the basis that the insurer of the car failed to put forward a reasonable offer.
How we helped our client
As a result of the accident our client suffered multiple injuries. These included an extra-articular displaced fracture of the wrist which required a number of surgeries and resulted in neuroma (a “pinched” nerve) causing hypersensitivity and paraesthesia in the hand. Our client also suffered from several psychological symptoms including a specific phobia of cycling.
Our client required assistance with day to day activities from family members due to his injuries. He was also absent from work on several occasions due to the surgeries he required to undergo.
In addition to seeking damages for our client’s multiple injuries, we focussed on obtaining for him the best rehabilitation for both his physical and psychological symptoms. We arranged physiotherapy and cognitive behavioural therapy (CBT) from which he obtained great benefit in the resolution of his symptoms.
We obtained several expert medical reports which dealt with the numerous injuries sustained. These detailed the diagnosis, recommended treatment and anticipated prognosis for each of the injuries.
Settlement
We were able to obtain a settlement of approximately £33,000 for all our client’s heads of claim. This was over double the initial offer of £15,000 which was put forward by the third-party insurer prior to raising court proceedings.
