Our client was involved in a road traffic collision whilst working as a courier driver. They were reaching into the back of their van when suddenly it was struck on the passenger’s side by a van. The impact was so severe it caused them to fall backwards resulting in injury.
Our client suffered from a soft tissue injury to their elbow together with a mild concussion. As a result, they were absent from work until they had recovered.
Our client initially reported the claim to the third-party insurer who refused to deal with it. They stated that although the collision occurred, they disputed whether they had suffered injury.
Shortly after coming to us, we were able to recover our client’s medical records which confirmed that they did in fact suffer injury. Shortly after intimating the claim, we were able to attain an admission of liability from the insurer. We are also able to secure physiotherapy treatment funded entirely by the insurer.
In addition to the physiotherapy, we were able to arrange an MRI scan, again paid for by the insurer. Our client was also examined by an an independent general practitioner, and a consultant orthopaedic surgeon. These experts prepared reports on or client’s injuries which allowed us to accurately value the claim.
Due to non-cooperation with the insurer regarding settlement, we raised a court action on our client’s behalf. We then received an offer in settlement. Following careful review, we then returned with our own offer which represented a 30% increase to that offered by the third-party solicitor. This was accepted by the third-party solicitors.
