Circumstances of claim
Our client was driving along a rural road. Unbeknown to her, a tractor had spilled a large quantity of engine oil on to the surface of the road. As a result of this, her vehicle skidded on the oil spillage and crashed. She suffered neck and soft tissue injuries.
How we helped our client
We were able to trace the tractor and intimated a claim to the insurers of it based on a failure by the tractor owner to properly maintain the tractor.
They responded to us and denied liability. This was on the basis that the oil spillage was caused by faulty repairs to the tractor carried out by a local tractor repairs shop.
We therefore required to raise a Court action against the tractor driver. His insurers brought the tractor repairs shop into the Court action seeking indemnity for compensation payable to Susan. We then instructed an orthopaedic opinion.
Settlement
A settlement was then agreed with the insurers of the tractor owner and repair shop, which was acceptable to our client.
