The Pursuer was involved in a road traffic accident on the B830 in Dumbarton. While stationary at a roundabout, her vehicle was struck from behind by another driver. The collision was sudden and unavoidable, and liability was admitted by the insurer shortly after the incident.
How we helped our client
Due to her age and health, the Pursuer was assisted throughout the claim by her son, who acted as her Litigation Friend. A Litigation Friend is someone appointed to help a person who may not be able to conduct legal proceedings themselves, due to age, health, or capacity. The Litigation Friend makes decisions in the best interests of the Pursuer, instructs solicitors, and ensures the claim is properly advanced.
Following the accident, the Pursuer suffered soft tissue injuries to her upper and lower back, right shoulder, and developed travel anxiety. Her symptoms were ongoing and required medical attention from her GP and at the Royal Alexandria Hospital. She was recommended for physiotherapy and cognitive behavioural therapy (CBT) to address both physical and psychological symptoms.
To support the claim, we obtained detailed medical reports from her GP, an Orthopaedic Surgeon, and a Psychiatrist. These reports confirmed the nature and extent of her injuries, the impact on her daily life, and the need for ongoing treatment. The Pursuer also required care and assistance at home.
Settlement
The claim was presented under several heads: solatium (compensation for pain and suffering), services (care and assistance), and miscellaneous expenses. The sum sued for reflected the seriousness and ongoing nature of the Pursuer’s injuries, as well as the costs of recommended treatments. With the support of her Litigation Friend and robust medical evidence, the Pursuer was able to secure a settlement that recognised both her physical and psychological injuries, her need for care, and the disruption to her life.
