Circumstances of accident
We acted on behalf of our client in an action for personal injury after he was struck by a vehicle.
Our client, having just parked and exited his vehicle, was struck by a vehicle attempting to reverse into a space. He was thrown over the bonnet of his own vehicle and fell to the ground, to his injury. As well as suffering from a number of soft tissue injuries which required extensive physiotherapy treatment, he developed PTSD as a result of the accident.
The insurer of the vehicle failed to respond to the claim and we thereafter raised Court proceedings against them.
How we helped our client
Our client was signed off sick from work due to his symptoms for a period of one year and lost earnings as a result. He was on benefits during his extensive time off sick.
The lost earnings claim was therefore offset against the benefits that he had received instead.
As well as recovering compensation for our client’s injuries, we were also able to recover damages for the assistance he required with everyday tasks following the accident.
Settlement
The insurers of the vehicle made an initial offer of £15,800 which included the sums to be repaid to the Department for Work and Pensions (the DWP) in respect of the benefits he received for one year. Ultimately, we achieved settlement of around £29,000 which was inclusive of the sums to be repaid to the DWP. Our client was delighted with the result and was particularly pleased that he would be able to move on from what was a traumatic accident for him. His damages have allowed him to start a new business venture.
