Damages given after learner fails to give way at roundabout

Our client was driving their vehicle in South Lanarkshire when they approached a mini roundabout. When safe to do so, our client entered the roundabout intending to turn right. Our client’s indicator was showing their intention to turn.

A learner driver, on a driving lesson at the time, failed to give way at the mini roundabout and collided with the front of our client’s vehicle.

How we helped our client

We requested a medical report from a General Practitioner to comment on our clients’ injuries and prognosis. We arranged physiotherapy treatment to assist our client in their recovery.

A claim was intimated to the Insurers for the Third-Party driver. No response was received, and a court action was subsequently raised. 

Issues with the claim

The Defenders denied liability for the accident. In their response, the Defenders advised that our client was not indicating and collided with the Defender’s vehicle, which was established on the mini roundabout.

We carried out liability investigations and obtained dashcam footage which showed the learn driver was not established on the roundabout prior to the collision. We obtained an opinion from a road traffic collision expert who advised that within the footage, you could hear an indicator prior to the collision.

Settlement

Following receipt of the dashcam footage, the Defenders made an offer to settle our client’s claim. Our client’s claim consisted of injuries, vehicle damage, service, hire vehicle costs, and treatment costs.

Settlement was subsequently agreed at £17,975 inclusive.
